Seit 01.01.2006 können neben natürlichen Personen auch juristische Personen und Personengesellschaften (dh Unternehmen bzw Verbände) strafrechtlich zur Verantwortung gezogen werden. Dementsprechend können Unternehmen bzw Verbände von Strafverfolgung – gleichermaßen wie natürliche Personen – betroffen sein.
Die speziellen Regelungen zur Strafbarkeit von Unternehmen bzw Verbänden finden sich im Verbandsverantwortlichkeitsgesetz. Dieses ist mittlerweile ein integraler Bestandteil des österreichischen Strafrechtssystems. Die Anwendungspraxis und Bedeutung des Unternehmensstrafrechts nehmen laufend zu. Vor allem die zuletzt erfolgte Anhebung der möglichen Verbandsgeldbußen wird auch in Zukunft den Bereich des Unternehmensstrafrechts weiter in den Fokus rücken.
